Commercial Terms And Conditions
Briorack (Brio) is committed to providing the highest standards in quality and innovation. We employ quality-control standards through all manufacturing processes to ensure the utmost trust among our customers.
Briorack Co. Ltd. (hereinafter referred to as “the Company”) Standard Terms and Conditions of Sale (hereinafter referred to as “Standard Terms”) shall govern all sales and quote transactions. Standard Terms may only be altered by an officer of the Company and any alterations must be documented in writing.
It will be assumed that the Customer has accepted the Company’s Standard Terms when a purchase order is submitted. The Customer’s purchase order does not bind the Company. An order is not deemed to be accepted unless it has been officially confirmed in writing by the Company. Prior transactions, customs or practices will in no way alter the Standard Terms or affect the Company’s written order confirmation.
Acceptance of an order is subject to credit approval at the time of order. Acceptance of an order is subject to payment in advance. First-time orders for new customers may be subject to down payment and/or other stringent terms regardless of credit status.
All prices are subject to change without notice. List prices on the Company’s website are available in US currencies. List prices include all associated duty and brokerage as of the quote date for any applicable cross-border transactions in our US$ prices only, unless otherwise specified. Prices are subject to change based on new or unforeseen tariffs. List prices do not include shipping charges or applicable taxes. To determine shipping charges and/or applicable taxes, please request a formal price quote.
Formal quotes include shipping costs as discussed in “Shipping and delivery” below. Prices do NOT include any new or unforeseen applicable tariff costs that come into effect after the quote date but before the order date.
If required, a request for information pertaining to the country of origin should be made prior to placing an order. Country of origin information will be included in all formal quotes.
All expected delivery dates provided by the Company are estimates, are dependent on current order volumes and are not guaranteed.
In-stock products are shipped from the Company’s head office or alternative warehouse locations in China. Allow up to 21 business days for processing. For premium color powder coatings, add an additional 2–3 weeks processing. Additional color-matching services may require additional time. For additional information, contact the Company’s Sales Department.
All shipments are quoted and delivered according to the following terms set by Incoterms 2024 unless otherwise requested by the Customer and approved in writing by the Company.
Delivered Duty Paid (DDP) for customers: The seller bears all the costs and risks involved in bringing the goods to the place of destination and has an obligation to clear the goods not only for export but also for import, to pay any duty for both export and import and to carry out all customs formalities.
Unless otherwise specified, standard shipping requires a dock or forklift be used to safely unload products upon delivery. It is the responsibility of the Customer to ensure adequate means for unloading are available. Additional freight options are available—including but not limited to: residential delivery, power tailgate lift for curbside or street delivery, and inside delivery. The Company must be made aware of any special delivery requirements prior to shipment (preferably, when requesting a quote). Expedited and international shipping options are also available upon request.
The Customer is responsible for all shipping and handling fees for deliveries that require redelivery or are unclaimed, refused or returned to the Company. Shipping and delivery charges are non-refundable once the shipment leaves the Company’s warehouse. Shipments must be inspected by the Customer upon receipt. Any damage or discrepancies should be recorded with the freight carrier and reported to the Company immediately. The Company is not responsible for indirect, special or consequential damages, losses, costs or inconvenience to the Customer relating to any cause arising from the sale of products to the Customer or delay in delivery of products to the Customer when such causes are due to situations beyond the Company’s control—including but not limited to labor disputes, production delays, equipment failures, credit processing, third-party shipping delays, delays in customs processing or natural disasters.
Please check your specifications and needs carefully before ordering to avoid the expense of return. Undamaged items will be accepted for return subject to a 25% restocking fee; damaged items may incur additional repair costs or may be non-refundable. Sales tax, Tariff and freight payments are non-refundable and return freight costs will be billed to the customer. All product returns must be made within 90 days of purchase date. Custom orders cannot be returned after production. If cancelling or changing a custom order before production begins, customers are responsible for all costs associated with the work until that point.
At Briorack, we don’t just build racks; we stand behind every journey you take. As long as you are the original purchaser and still own the product, our commitment to you remains in full effect.
- Our Promise: Tiered Support
Structure & Craftsmanship (Lifetime): Under normal and intended use, we will repair or replace—at our discretion—any parts that exhibit cracks in welds, structural metal fatigue, or failure of core mechanical functions (such as folding mechanisms or non-accidental lock failures) at no cost to you for the lifetime of the product.
Functional Accessories (2-Year Warranty): We provide a dedicated 2-year warranty from the date of purchase for high-wear functional components, including Gas Struts (Gas Springs)and Wheel Strap Parts. If these parts fail due to manufacturing defects within this period, we will provide replacement parts free of charge.
Material Defects: If a defect in the manufacturing process prevents the product from meeting its rated load-bearing strength, we take full responsibility for its restoration or replacement.
- The "Boundaries": What is Not Covered?
While we build our gear to last a lifetime, the following conditions are not covered under the free warranty (though paid repair parts may be available):
Wear & Tear (Aesthetics): Fading due to prolonged UV exposure, minor surface oxidation/rust in high-salt or coastal environments, or the natural hardening/weathering of rubber straps beyond the 2-year accessory warranty period.
"The Unexpected": Damage caused by driving into garages, low-clearance structures, or car washes while the rack is mounted (these are typically insurance matters, not product defects).
Improper Use: Exceeding the rated load capacity (e.g., mounting heavy e-bikes on a rack designed for standard bikes) or mounting on uncertified/non-standard hitch receivers.
Exhaust Heat Damage: A common issue for hatchback owners. Melting of wheel trays or straps caused by proximity to high-temperature exhaust fumes is considered an installation error and is not covered.
- How to Start a Claim (The 3-Step Process)
Proof of Identity: Please provide your original proof of purchase (digital invoice, order screenshot, or warranty card). This warranty is non-transferable and does not apply to second-hand owners.
Documentation: Take 2–3 clear photos or a short video describing the issue and the context in which it occurred.
Contact Us: Reach out via our service hotline or visit your local authorized dealer. If your specific model has been discontinued, we will provide a compatible part solution or offer an exclusive "Trade-In" discount toward a newer generation.
- Pro-Tips for Enthusiasts
Register Your Gear: We strongly recommend registering your product online within 30 days of purchase. This ensures your "lifetime ticket" remains on file even if you lose your receipt.
Periodic Check-ups: Before every long trip, please check the torque on all bolts. While we guarantee the structure for life, maintaining the tightness of fasteners is the owner's responsibility.
The Customer will protect and indemnify the Company against all claims of infringement of patents, designs, copyrights, trademarks or trade names with respect to any products manufactured wholly or in part to the Customer’s designs or specifications.
